Question:

I am contemplating a complaint against my lender but they are no longer a legal entity in Calif and have been absorbed by a larger bank. The statute is very clear that the original lender cannot defend themselves and would lose the suit. (Though I understand the judge may halt the proceedings and allow them to get re-certified but if they do that it would allow liability for all other suits they have against them or settled.) Am I missing something?

Filing a lawsuit against a financial institution or bank is not a small task. If you are seriously contemplating such a lawsuit, hire an attorney.
